Death on the High Seas Act
When the death of an individual is caused by wrongful act, neglect, or default occurring on the high seas beyond 3 nautical miles from the shore of the United States, the personal representative of the decedent may bring a civil action in admiralty against the person or vessel responsible. The action shall be for the exclusive benefit of the decedent’s spouse, parent, child, or dependent relative.
The compensation for the loss to the individual will be fair and the court would apportion the recovery among those individuals in the proportion to the loss.
Longshoreman and Harbor Workers Compensation Act
The Longshoreman and Harbor Workers Compensation Act was established to fill one of the many gaps present in the Jones Act. The act was made to benefit maritime workers who are not seamen as well as their survivors.
The Longshoreman and Harbor Workers Compensation Act adds of the following workers to the Jones Act:
Loading and unloading vessels workers.
Repair vessel workers.
Building vessels workers.
Wharf workers.
Dry dock workers.
Terminal workers.
Pier workers.
Aquaculture workers
A master or member crew of any vessel
