The Jones Act (Mechant Act of 1920)
The Jones Act is law that was established to protect maritime workers who are constantly exposed to the dangers of working in this industry. While some accidents are inevitable, others are attributed to employer negligance. When the law was written, the martime industry was not the same as it is now. Therefore the law makers did not aticipate the changes that would happen between the law's date of establishment and now and the law has been interpreted in various ways to compensate for the inconsistencies in the law.
The Jones Act has become difficult to interpret since then, but not difficult to understand. The Jones Act in basic terms, allows quailifed a Jones Act Seaman to sue his or her employer when the employer is considered at fault for the injury of the employee.
Injuries include, but are limited to:
Injury from faulty equipment
Injury from negligent equipment operation
Injuries caused by exposure to hazardous materials.
If your job places you anywhere in the water it is very likely that you are covered by the Jones Act. Because of the changes and the addition of the Longshore Harbor Act, a person injured is now covered. Many people make the mistake that when they are injured, that they are protected and covered by Workers Compensation. Workers Compensation is not always the solution for this type of injury.
